Posted on June 20, 2013

The final panel discussion at MFA’s Forum 2013 featured experts speaking on the protection of customer assets.  The discussion focused on the risks that CTAs and CPOs are exposed to, and the solutions available for mitigating risk.

The speakers during the “Best Practices Solutions for Protecting Customer Assets” included:  Diane Mix Birnberg, Founder & Chairman, Horizon Cash Management; Ann Cheeseman, Partner, Financial Services, Ernst & Young LLP; Steven W. Kastenholz, Treasurer & Global Head of Portfolio Management, Newedge; Carl Lingenfelter, Chief Administration Officer, Northern Trust Hedge Fund Services; and Elizabeth Schubert, Partner, Sidley Austin LLP.  Olivier Zeyssolff, Chief Credit Officer, Tudor Investment Corporation moderated the discussion.

Panelists discussed the controls needed and how a futures commission merchant can demonstrate to its customers that it is safeguarding their assets.  Other topics covered included how often a CTA or CPO should verify its assets or investor assets, and the latest regulatory developments for the industry.  The discussion also touched on whether the current regulatory framework is stringent enough or could be made more robust, and whether any alternative models could offer greater customer protection.
