Comment Letter to SEC on Security-Based Swap Data Repository Registration, Duties, and Core Principles

MFA submitted a comment letter to the SEC on Security-Based Swap Data Repository Registration, Duties, and Core Principles. In our letter, MFA echoes the SECs concerns about confidentiality of security-based swap (SBS) transaction data, and thus, we urge the SEC to impose a standard of care on security-based swap data repositories (SBSDRs) that is consistent with terms generally requested for confidentiality agreements between two SBS counterparties. We also support giving regulators appropriate access to SBS data maintained by SBSDRs, but request that the SEC implement requirements that will ensure that only regulators acting within the scope of their authority have access to such data.
